Fox files counterclaim against GENM, seeks damages


The legal dispute between Genting Malaysia and Walt Disney’s Fox Entertainment Group has intensified after Fox filed a counterclaim seeking damages over an alleged breach of contract.

On Tuesday, Fox Entertainment Group, together with Twenty First Century Fox Inc (21CF) and The Walt Disney Company filed a reply to a November lawsuit initiated by Genting.

At the same time, Fox also filed a counterclaim against Genting Malaysia, alleging breach of contract and breach of the implied covenant of good faith and fair dealing.

The company is claiming a monetary sum of approximately $46.4 million in respect of annual license fees, guarantee amounts or royalties and travel reimbursements, as well as consequential damages, reasonable costs, and other relief.

Genting Malaysia said it is now in the process of reviewing the claim with its legal counsel and intends to file a timely response.

The legal spat between the companies began in November 2018 after Genting Malaysia filed a lawsuit claiming Fox and Walt Disney Co. went back on its deal to open a Fox theme park in its Malaysia property.

The company is seeking $1 billion for the cost of its investments and consequential and punitive damages.
