Genting defends Las Vegas project, says Wynn fails to demonstrate harm


Genting Bhd has been given an extension to respond to a lawsuit that claims that the design of its planned Las Vegas resort copies that of neighbouring Wynn Resorts and said construction on the property continues and remains on track.

Wynn filed a lawsuit on Dec. 21st claiming Genting’s new property was deliberately designed to confuse clients.

Genting says that assumption is “speculative extrapolation” given the project is in the early stages of construction with nearly two years to go before opening. It says the completed project “will look dramatically different from Wynn’s properties.”

“WYNN has failed to demonstrate the threat of imminent and irreparable harm, which is a key requirement for the granting of any order of temporary or preliminary injunctive relief,” Genting said, adding that Wynn “did not adduce any evidence or provide any coherent or credible explanation of how a construction site that is not providing or marketing any service whatsoever could have such detrimental effect on the Plaintiff’s reputation and goodwill, nor satisfy the requisite showing that such an effect is both likely and imminent.”
