Greyhound racing ban could be considered unconstitutional


The NSW government’s proposed ban on greyhound racing may have hit a major roadblock, as key elements of the industry operate across state borders, local media reports.

In July, the NSW government became the first Australian state to announce a ban on greyhound racing following an inquiry which found overwhelming evidence of animal cruelty.

At the time, NSW Premier Mike Baird said the "widespread and systemic mistreatment of animals" would not be tolerated and that the government was left with "no acceptable course of action except to close this industry down.”

However, constitutional lawyer George Williams said parts of the ban that would have an impact on interstate trade could be considered unconstitutional, The Australian reports.

There are currently training and breeding programs in NSW that service the industry in other states, which would be allowed to continue under section 92 of the commonwealth Constitution.

The NSW Greyhound Breeders Owners and Trainers Association reportedly launched Federal Court proceedings against the ban on Tuesday.
