Spartan Poker in lengthy legal tangle

A legal tug-of-war over the ‘Spartan Poker’ brand is heating up, with Pokerguru planning to file a lawsuit against promoters of the Indian Poker Championship (IPC), Glaws reports.

Last month, a public notice was posted on SpartanPoker.com (owned by Pokerguru), stating that Pokerguru had no control over the operations of Spartan Poker (owned by IPC) and that legal action would be initiated against the owners of IPC for copying its brand.

Within a few hours, the IPC group claimed they were the real owners of the ‘Spartan Poker’ brand.

However, it is unclear who is the owner of the trademark and intellectual property rights of the brand ‘Spartan Poker’. While public search on the government of India trademark registry indicates that both Rajat Agarwal (Pokerguru) and Quadrific Media (IPC) have applied for trademark of ‘Spartan Poker’ under Classes 41 (entertainment and gaming category) and other classes, neither parties had been approved for the registration of the trademark.

It seems that the dispute between the two factions will now have to be settled by a legal authority and the online poker community is likely to witness a long and protracted litigation, according to Glaws in a report.
